Unlocking the Chains: A Legal Analysis of Judicial Pardon in Aggravated Theft Assistance Cases

This research explores the application of judicial pardon in cases of abetting theft in aggravating circumstances, addressing the need for more humane and flexible legal responses in Indonesia. As individuals' needs vary, the inability to fulfill them can drive some to resort to criminal acts, such as theft. Increasingly, cases of theft involving low economic value raise concerns about fairness and justice, especially when the perpetrators face harsh punishments that may not align with the severity of the offense. In this context, judicial pardon offers an opportunity for mitigating punishment, acknowledging both the circumstances of the crime and the social realities faced by offenders. This study analyzes the legal framework for implementing judicial pardons in Indonesian criminal law and examines judicial decisions related to their application. Using a qualitative, empirical juridical approach, the research combines primary data gathered through interviews with relevant stakeholders and secondary data from literature. The novelty of this research lies in its examination of how judicial pardon is applied in theft cases that involve aggravating factors, shedding light on its potential as a tool for achieving justice that balances legal principles with societal needs. This study contributes to the ongoing discourse on the flexibility of the Indonesian legal system, advocating for more compassionate judicial decisions that reflect the complexity of human behavior and the broader socio-economic context.Referensi
